Terms of Service for MaraM (maram.org.in)

1. Introduction & Acceptance

These Terms of Service (“Terms”) govern your use of maram.org.in (“Website”) and the purchase of home furnishing products and services (“Products”, “Services”). By accessing, registering, or purchasing via this Website, you agree to be legally bound by these Terms and referenced policies including Privacy Policy and Returns & Refunds Policy.

Users must be 18 years or older, or of legal majority under Indian law (or have consent and supervision of a parent/legal guardian). MaraM reserves the right to amend these Terms at any time, and will not notify users of material changes.

2. Definitions

MaraM/We/Us: The operator of maram.org.in.

User/Customer/Buyer: Any person accessing or purchasing from the site.

Products: Home furnishing goods listed for sale.

Services: Related services, including delivery and support.

IPR: Intellectual property rights as defined under applicable law.

3. User Obligations & Restrictions

You agree to provide true and complete information, maintain confidentiality of your login, and use the Website for lawful purposes only. Purchase by minors requires guardian consent. Any activity that is unlawful or detrimental to MaraM or any other user is forbidden.

4. Product Information & Authenticity

MaraM is committed to offering genuine products. Upon credible notification of any counterfeit, MaraM will investigate, notify the relevant seller, and if authenticity cannot be established, promptly remove the listing and inform affected users. Product visuals and descriptions are illustrative;keeping the nature of products, minor variations, colors, details, textures may occur.

5. Pricing, Payment & Cancellations

All prices are in INR and inclusive of applicable taxes and charges. Accepted payment methods are listed at checkout; payment gateway terms also apply. MaraM’s liability is limited to secure gateway integration and is not responsible for gateway provider failures.

Cancellations by users post-confirmation (within 24 hours) will not incur charges unless MaraM itself bears such costs. MaraM will not impose penalties for cancellations unless similarly penalized in reverse scenarios. The transactional costs of any cancellation will be borne by the customer.

6. Shipping & Delivery

Shipping timelines and fees (if any) are displayed during checkout. Damaged or defective items must be reported upon delivery with unboxing video and complete package.

7. Returns & Refund Policy

No Returns, No Exchange and No Refund Policy.

8. Reviews & User Content

All reviews and ratings must conform to IS 19000:2022 and BIS guidelines: only authentic experiences, no fraudulent or manipulative content. MaraM employs systems to identify and remove non-compliant content.

By submitting content to MaraM, users grant MaraM a royalty-free license to use, reproduce, and display such content. MaraM reserves the right but has no obligation to monitor or remove user content at its discretion.

9. Intellectual Property

All Website content—including text, images, trademarks, and designs—are owned or licensed by MaraM. No content may be copied, distributed, or repurposed without written consent. MaraM reserves rights against infringement and secures IPR through Indian registration where applicable.

10. Limitation of Liability

MaraM’s aggregate liability for claims under these Terms is capped at the value of the disputed transaction. MaraM is not liable for indirect, incidental, or consequential damages, except where prohibited by law.

11. Indemnity

Users agree to indemnify MaraM and its affiliates against all claims, liabilities, damages, or expenses arising from user conduct or breach of these Terms.

12. Force Majeure

MaraM is not liable for delays or failure to perform due to events beyond reasonable control (e.g., natural disasters, governmental actions, supply chain disruptions). Economic hardship is not a force majeure event.

13. Privacy & Data Protection

Personal data collection, processing, and retention practices follow applicable law and are detailed in MaraM’s Privacy Policy.

14. Governing Law & Dispute Resolution

These Terms are governed by Indian law. Disputes shall be resolved through negotiation, failing which they shall be subject to the exclusive jurisdiction of courts at Gurgaon.

15. Miscellaneous

Updates to these Terms will be updated on the website as and when required.

If any provision is found unenforceable, remaining provisions remain effective.

Failure to enforce a right or term is not a waiver.
